So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??
And if the LCA is denied because the DOL doesn't recognize the FEIN what options have we got..Can the employer reapply for LCA or just submit the Info and wait for info from DOL ??

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....

did my first MS, got First OPT ...worked on OPT..didnt find a job..
went back did my second MS..got another OPT...and moved into non-quota H1 (research field at a hospital)
now plan to go back and get an MBA..
1.) will i get an OPT after my (fulltime) MBA??? (as i already have 2 OPT's)...is there a limit of OPTS?
2.) Since i was a non-quota H1..will i have to apply for the quota H1 when and come out of MBA...which is basically a lottery system now!!! (and if i dont hit the jackpot that will put me out of status immediately after )
any inputs are appretiated!!

sorry to break it to you - but he's quitting a very happy man as every other rupublican is trying to 'out-tancredo tancredo' as he himself put it. he's done his job and poisoned the atmosphere which is all he wanted to do.

I can't really help much, but I would say that going Canon won't actually help (unless you would be happy to use the Canon Digital Photo Professional tools, which is a simpler variant of lightroom, sort of).
New formats of RAW format always needs newer versions of software.

I looked at the list of civil surgeons that approved by USCIS. I called some of them and everyone told me differently in pricing. The basic I693 test would cost around $$220, and if i need vaccines, It would be an addition cost. Like some said the MMR vaccine would cost $120, the other said $50
Lot of them said the cost for chicken pox vaccins is around $120 ( I dont have insurance). My parent is not really sure if I ever have chicken pox or not so incase I need one, DO you know where to get those shots cheaper? Thank you for your time!

I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?
Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.
Let me give my case background in details.
* LC applied in oct'07
* I-140 applied in May'08 after LC approval
* 6th yr on H1 ended in June 08
* had to return India since my LC < 1 yr and I-140 was not approved
* Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
� Mar09- applied 7th yr extension based on Approved LC (> 1 yr old ) and applied I-140
� Apr09- I-140 approved

My month-in-law was born in a village about sixty five years ago, and nobody is aware of her precise date of birth. So we filled a date that was the most probable date as per our best judgment.
We forgot about the matter till now. However recently my folks back in India got a passport made for my mother-in-law. In the passport they filled a different date of birth (same year, different day and month). I came to know of this issue when we were planning to obtain a visitor visa for my mother-in-law.
How will this issue impact our pending I-485 applications, and the chances of my mother-in-law obtaining a US visa. It was a genuine mistake with no ulterior motives whatsoever. However now the lady has two different DOB in two different set of documents (her passport and her daughter's I-485 application). Should we take any steps to rectify the matter, or just ignore it.

Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

Hello folks
My fiances parents are applying for a B1/B2 Tourist visa on the basis of her 2 graduation ceremonies. We will get married in a court before her parents apply for a visa but the marriage ceremony will be between 2 graduations in US. If we also show that her parents are attending daughters wedding ceremony in US will the likelihood of them getting a visa increase? We can send a copy of marriage certificate before parents visa interview.

My wife went to US consulate in Kuwait for her H4 stamping on Feb 18th. During the interview she was informed that some administrative process on their end was not completed and asked to pay for the DHL service and was told that she would be contacted by DHL who would collect her passport, get the visa stamped and return it to her. She was also told that it should not take more than 2 weeks.. On her application form, the interviewer wrote NO PIM.
Since then it has been a harrowing time for us. It has been 6 weeks, since then and we still have not heard anything. We have tried contacting the consulate using phone, email and at times my wife personally went to the consulate but she was not allowed to enter. We do not hear anything back from them.
I can understand a couple of weeks, but now its more than 6 weeks and counting. We have already cancelled her and my son's flight tickets once. We have rescheduled my son's doctor's appointment. This delay is having a domino effect on our lives.
My question is - Is there anything that we can do to expedite this process.

Interesting situation. Technically you will be better off on H1 (since you have that approved for 3 years). I would do that if I were you.
Only issue I can think off is, f your husband (Iam assuming primary 485 applicant), would move over to EAD (after Sep-07), would that impact your H1 in any way(I don't think it should).
