Tough times are upon us again. Been there, like I'm sure many of us have - fresh graduate in '01 coming out in a recession & survived, recovered, only to face another, maybe worse, in '09-'10.

Only he can file I-130 for brother/sister. It is his petition.
I-485 need to file when your PD need to be current.
Indian Bro/sister need to wait 10 years to file I-485.
So you can file I-485 in 2020 AD.

Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

For now you can use EAD and continue to work.
In Long term you can get your GC refiled from a different company and port priority date

I don't understand this, we are talking about these backlogs, which are effecting about 300K - 500K skilled immigrants, and we only have about 4000 members yet. We should take this as challenge and go on to drive to speak to people like us to increase the members strength, so we will have significant backing and Senate / House / President will pay attention to what we request.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?
Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!
sir, if you have worked 180 days for this employer after filling of 485, there are no issues with CIS, atleast legally. However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy. (http://immigrationvoice.org/forum/showthread.php?t=22182) It is actully very easy, just print 4 pages and mail it thru' USPS. Won't even cost you $2. One of the biggest gripe, that legal retrogressed immigrants have about the immigration system here, is that the current retrogression locks them up in one position far too long for them to grow in career. Either your company was not advised properly by your attorney or you were not aware of this simple rule that you need to work in the same job category (with as many employers as you wish subject AC21) until about six month passes after you get your green card. Otherwise you could run into trouble at some point.

I am applying 485 for me and my wife.My wife got H1 in Oct 2006 but she didnt work until now So she dont have any paystubs.So my attroney suggested to do it on H4 but her H1 is to be collapsed for that she is planning to go canada (not for stamping)and come back so that her H 1 will be collapsed and H4 will be there.I came to know from my friends that canada people are not givng any I 94 for visitors who travle by road.If we request for I 94 they are asking to keep the same I 94 which we have in our respective document.I just want to know how to get the new I 94 for her?
And also Please suggest If there is any way to apply for 485 without cancelling her H1.

I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
Does this mean any thing. Message content is not changed though.

1. When can i expect my EAD ?
2. Is there any rule that i shud start working within some stipulated time after getting my EAD or i can take my own time ?
1. it should take another week or 10 days...
2. you could start when you want....

I agree that you should just send the G-325, if that is all they ask for. Just follow the instructions on the RFE regarding how to respond.
