You are right - based on my personal experience, Like Doctors, it is always good to have an attorney physically reachable; it will be handy when the need arises. I guess, the OP is looking on similar lines.

Well, everyone should be proud of IV's great volunteers too who have always proved their consistent success from time to time - though big sucess yet to come! As these volunteers are just like one of us who are working full-time in their job and contribute to IV as and when they can - but I always felt that IV is managed by bunch of full-time professionals with so efficient and accurate manner! Their leading efforts to solve legal immigrant's problems are really commendable!! We are equally graced with great IV members who contributed $$ generously every time (and hope they will keep continue) and helped other way too (e.g. live update of senate sessions, news links, new immigration bills, etc...).

Hi All
I am on a B1 - Visa visited 4 times to USA.But last time (4th time) i over stayed for about 20 days after the i-94 expired.
Normally first 3 times they gave i-94 for 3 months, last time it is only for 2 months, so it's my mistake i haven't looked it till iam
back. All this happened in June 2009. Now i am aproved for H1 - B for the year 2010. I need to face a visa interview. In DS 156
Application, Question No 38. ( Have you ever voilated the terms of a U.S. Visa or Been unlawfully present in,........)
I am checking the option Yes. Can you all help me in this please. Does 20 days extra stay will effect my H1 - B visa or if i get
the Visa, when i go to USA on H1 - B Visa does immigration stop me. Please help me on this case. Thanks a lot for all your
help.

How long will it take to get the receipt number when we apply for H-1 extension? And how long will it take to get the decision?
I am assuming when I have the receipt number, I can be considered to be in legal status and keep working with my present employer though I-94 is expired.
Please help with your answers/suggestions.

It is required that you send photos for your ead as they put your picture on the actual ead card. I did not apply for AP so I am not sure about the requirements for that. Good luck to you.

Monthly ~250 allocation is not good enough to cover pending cases prior to May 2006. prior to May'2006 no.of pending cases are close to 2700 cases, so this year quota is good enough to clear these pending cases. With porting we may also see Unavailable down the time.
This leaves for 2006 pending cases
China - 2950
India - 11800 . total ~15K
If we get spill over of 14K then EB2 India & China will move to 2007. Do we get 14K spillover for current year is Big ?

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.

Hi,
I received a notice this morning for my spouse's case! This is the third (or may be fourth) time they have transferred the case! The notice reads:
On May 16, 2011, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. .......
During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to .........
All standard stuff. Not sure what that means. We are getting current on June 1st. I have not received any such notice for my case, only for my spouse's case.
By the way, we have never been interviewed, have provided fingerprints probably three times.
Does that mean that now the case needs additional 4 to 6 months of processing?

I suppose you are doing consular processing? Right? Well, when the consulate is aware that your PD is about to be current, and if all other tasks are completed, they should send you packet 60-90 days in advance of your interview.

tom friedman doesn't know about the details of this issue..... for him immigration means more h1b visa..... he doesn't have a clue @ gc mess...... there r others who have done research on this subject.... but those studies did not get as much attention.... maybe others need to come up with a shape... lets pick one.... lets say "earth is rhombus".... and then publish these reports... that might help catch some attention....

Recently my company got acquired by another company. Co A had filed for my LC, and was approved in Feb 09, and my i140 was filed in EB3 in Sept 09. Co B wants to keep me, and I will continue the same job. My H1 has also been transferred to Co B. My question is:
will there be any effect on my LC and I140? If so, what happens to my PD (Nov 08)

Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.
What are the timelines for I-539 Change of Status for H1 to H4?

Maybe some of you can help me with my problem. I was directly hired to work in the US with two other colleagues. Our PD was April 04. We got our LC�s last year. My two friends and I applied for I-140 last December 2006. (same job, same employer sponsoring us). The two got their I-140 by June and were able to receive their GC courtesy of the July fiasco.
Last May 07, I was told that I was mailed an RFE. I never received it. As you may know, you can only follow this up after a month. Three phone calls (and months) and two faxes (two months) later, still no letter. My lawyer is at his wits� ends. The other day, he gets an appointment at a USCIS center near our area. He says this office �has no jurisdiction over my case� and that this was a long shot. An immigration officer looks at the computer system in the office and says that the system�s list of RFE cases does not include my name, and perhaps there was an error. Perhaps�
Has anybody heard of a similar case? My lawyer is now suggesting that I write a congressman for help. Do you think this will help?
My husband and I filed our I-485 + his EAD last July 19. Today we received acknowledgment receipts for both and a notice that we have to go thru FP next week. . Is this a positive sign , or does this mean nothing at all? I noticed that current PD for 3rd preference visas has rolled back to Aug 02.
