India has expressed its concern to the Chinese government over Beijing issuing visas on a separate sheet of paper to Indian nationals from Jammu and Kashmir instead of stamping them in their passports. Ministry of External Affairs (MEA), India strongly believes this, as a well-thought-out strategy to question the status of its state Jammu and Kashmir. It has been issuing visas stapled to passports to people from Arunachal Pradesh who have traveled to China since 2007.
MEA spokesperson Vishnu Prakash says �We have conveyed our concern to the Chinese government in this regard. It is our considered view and position that there should be no discrimination against visa applicants of Indian nationality on grounds of domicile or ethnicity.�
It�s not clear when the Chinese started issuing visas on a separate sheet of paper to Indian travelers of Kashmir. The matter came to light when immigration authorities at New Delhi International Airport, India turned away Kashmiris carrying the standalone visas, assuming they were fakes. The Chinese embassy however issued letters confirming that it had issued valid visas. The matter was then brought to MEA�s notice, prompting it to take up the issue with Beijing. Immigration authorities have been directed to treat the standalone visas as invalid.
This is just to brought some Immigration development in other parts of world. We strongly belief that both the Asian neighbors will resolve such issues amicably soon.

Hi All,
I have a strange issue, paining me since I have joined this new company, ( I am using AC21, since I am on EAD and AC21 is not yet filed). I am one of those unlucky fellows with really long name(First Name) stuck on my passport, and I have been using this all along, as my legal name while applying for visa/485 related activities. However, I go by the last part of the First Name and so all my other records here (like DL, SSN card, Bank Accounts, 401K account, etc) have got the last part of the First Name as my first name.My H1-B visa had the complete first name printed on it, and so I have been thinking, people could see that the name I have been using is in the last part of the complete First Name on the Visa and Passport.
However, in the EAD card, the name got cut(or incomplete) as the entire first name could not be printed on it. When I showed this to the new employer, they are using the name as displayed on the EAD card(which is not what I go by) in all the accounts they are establishing, like Paycheck, 401K info, ESPP etc.
Now I am in a soup, I have requested them to use the last part of the first name, which they are chcking with their immigration lawyers. But in the meanwhile, I want to know, does any one has this kind of problem. What should we do if the name is incomplete on the printed EAD card? (Ofcourse once I get GC, I would rather change this damn name)
Any one has any ideas?

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?

I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husband�s citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

Today, I received an email from USCIS that my EAD application got approved. My receipt date is on the 3rd week of May of 2007. What I don't understand is that the current processing time at NSC for I-765(EAD) for pending I-485 is March 26th, 2007.....
They are not always up to date on their processing times.

As per my knowledge you do not need a transit visa for Dubai and Abu Dhabi. I traveled to India recently through Abu Dhabi and did not need one.

I am on L1B and working in US for last 3 1/2 years. My L1 visa will expire in Jun 2011. In between another company is ready to sponsor H1B for me and it will file it in April 2010. So here are my questions.
1. From when i can start working with new company on H1 ? From Jun 2010 (after getting H1 approval) or will have to wait till Oct 2010 ?
2. What will be the duration of my new H1B visa, considering i already used 4 years of my L1 ? Is it 6 years or only 2 years ?

My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.
Anyone here succeed in this?

AFAIK, your PD can be used across any EB - 1, 2, or 3 categories and not EB- 4 and 5. So in my opinion, you should be able to port your PD.

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

My wife is on H4 and with recent events, we applied for EAD. Our EAD was approved a month ago. I recieved mine but my wife did not. When checked with USCIS, they informed I have to wait for 30 days.
It would be great if the group can share thier experiances or has any advise on this issue?

Recently my I-140 petition for EB2 was denied on educational grounds . The employer opened an MTR/appeal.
Is it possible to re-file the I-140 petition in EB3 using the same labor certification, while the first I-140 is pending appeal at AAO.

I was employed by company A until from 2004 thru May'07 with labor and I140 approved in 2006, I was laid off from Company A in May'07 therefore I joined company B in June (transfered my H1).
In July , Company A agreed to file my I485 under future employment as all the EB catagories became current but I still work for company B (H1 with company B), now since in Jan'08 it will be past 180 days on my 485 application.
Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?
Answer is Yes. Company B should be prepared to confirm that they have a job (same/similar as in original LC) which they will offer you on permanent basis upon your getting GC. Note that current job with B is on H1 (means it is not permanent).
