Acting Associate Director Donald Neufeld has issued revised guidance regarding the
I-90 Application to Replace Permanent Resident Card. The guidance is dated February 6, 2009.
Previously, if an I-90 applicant presented a national security concern or had a record of arrest or presented an �Egregious Public Safety� concern, then the USCIS adjudicator was instructed to immediately suspend adjudication of the 1-90 and refer the case to ICE.
The problem with that position, as pointed out in the Neufeld memo, is that an I-90 applicant who is a Lawful Permanent Resident LPR holds that status until he or she either abandons it themselves or has it revoked through rescission or removal proceedings. Therefore, until the LPR status is either abandoned or revoked, the applicant is entitled to evidence of his or her status.
Now, the Neufeld memo provides that all 1-90 applications will be adjudicated when all of the basic filing requirements and conditions have been met:
1. The applicant has established his or her identity; and
2. It has been established that the applicant is a lawful permanent resident.
Once those conditions have been met, the I-90 should be approved regardless of whether derogatory information comes up during the fingerprint and IBIS checks. If that happens, the I-90 should still be approved first and the derogatory information issue addressed second, presumable with a referral to ICE.
In the past, some applicants have been served with Requests for Evidence (RFE) asking for arrest records or court dispositions. Now any RFE that is issued must be limited to requesting supporting documentation related to establishing identity or status.

I opened 2 SR 's on my name and 2 on my wife's name, no use at all.I am a july 2nd filer transfered from NSC to CSC, still in CSC only,not transfered back to NSC.

It will great help if some body can help regarding this.
I had my H1B from A Company,Recently i have moved to B Company where i was asked to go to UK for Business purpose.I have yet to have stamping from B Company.I still have valid visa till end of next year from Company A name stamping in the passport.Will there be any issues for comming back from UK without having stamping.

Yes..you can apply for AP. It is the only way you can reenter into US. I applied for my F1 (spouse) too.
Yes you can write that same reason for the AP appplication.
BTW your F1 is not valid anymore since you showed immigration intent. You are still legal status. If you have Tuition waver/ Stipend or oncampus job...you should also apply for EAD so that you can continue to earn money.
DO check with International office in your university.
I want to apply for AP but I'm not sure if I qualify and I don't want to get rejected as I cannot afford to lose the money. I am here on F-1 visa and got married and subsequently have applied for I-485 and got receipt for it.

2. I want to go home and visit family and/or have AP in case I need to leave. Is this a valid reason? Is this what I write as my reason on form?

In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".
My Employer wants to reply that this was a clerical mistake..... Is this right? or should he file a new petition.
Can I file another petition if this petition is rejected?
Just saying its a clerical issue wont be sufficient. It might help if your employer attaches a new LCA along with the RFE reply. Worst case, you have to withdraw and file again with the correct/new LCA. If this is a fresh H1, then you are lucky in the sense that the quota is still open and you can refile without having to wait for another year.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

Most of us with English as our native tongue are spoiled and speak no other language well. And, as Fred says, some of us don't do well with English either...
The mountains are nice, though, since both the foreground hill and background hill are the same apparent height, it does not have as much impact as it could have.
The gull shot is sharp, but will appeal to people more if you get them traveling basically toward the camera, rather than away from the camera as is the case here. I have also found that I like to have some space in front of an animal/bird/fish so it looks like they are going somewhere.
Just my opinion. The most important thing, of course, is that you like them :)

Just showed them the approval notice. Got passport stamped should I need to travel. Officer told me I have to wait. I've been reading on the boards that most people get them soon after.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Please advice how to proceed to get this process done properly, legally and fast, reasonably possible and how much time it would probably take. Thanks in advance!

I don't know about any of those lenses from personal experience, but for what it's worth, Bj�rn R�rslett rates the f/4 version at 2.5 out of 5 (on a D1x, which is similar in resolution to the D70), and doesn't have much praise for its image quality. I'd guess that the f/4-5.6 versions, being newer designs, should be better.
